New disability regulations took effect December 30, 2012 and are available here. The new regulations are 23 pages in length and contain definitions of mental and physical disabilities, explain essential versus non-essential job functions, and provide detail on employer and employee responsibilities in engaging in the interactive process and providing reasonable accommodation.
All California employers (in particular, their Human Resources or other personnel responsible for managing leave requests or accommodation requests) should review the new disability regulations to ensure that their practices comply with the standards set forth therein.

Unemployment dropped to 12.5 percent among people with disabilities last month, the government agency said. Though that remains significantly higher than the jobless rate for the general population, the news reflects a marked decline from the 15.2 percent unemployment rate reported in March among this group. The American Bar Association sponsored a webinar this week on the Americans with Disabilities Act, which was noteworthy for its inclusion of EEOC commissioners Chai Feldblum (Democrat) and Victoria Lipnic (Republican). Feldblum and Lipnic said that the EEOC is drafting new guidance on reasonable accommodation. The guidance may include what an employer can say to resentful co-workers who don't realize that the employee has a disability. Some realistic, practical advice in this area would be most welcome -- as it is now, confidentiality rules prohibit employers from saying anything, even if it might help co-workers understand and be more tolerant. A new unpublished opinion from the United States Court of Appeals for the Second Circuit reminds employers that requests by disabled employees for assistance with their commute to work are not inherently unreasonable under the Americans with Disabilities Act (“ADA”). An employer has an affirmative obligation to examine whether a reasonable accommodation exists that could assist an otherwise qualified disabled employee with his or her commute to work. Read more
